Peoa President Wilford Woodruff Salt Lake City Dear Brother Yours of March 6th recieved It was not a surprise when it came still I thought that perhaps it would not owing to it being two weekes since I had heard about this matter. As regards my condition Physically I do not think I could be better thank the Lord I am in the enjoyment of health to robustness. Mentally I am not better prepared than other men that have been brought up in these moun- tains from boyhood. Letter from Benjamin Franklin Cummings Jr., 10 March 1890
President Wilford Woodruff, City. Dear Brother:- In 1885 I purchased from my brother Horace Cummings a partnership interest in the firm at that time publishing the "Utah Journal" at Logan. A disagreement has arisen between us over the trans- action in consequence of which he filed a complaint against me before Bishop Joseph Pollard, a few days before the latter's death. At my re- quest Bishop Pollard wrote to Brother George W Thatcher of Logan, ask- ing him to send the books of the "Journal" to be used in evidence at the trial. I understand that Brother George W Thatcher has answered to the effect that he would refer the matter to Brother Moses Thatcher, to determine whether the books should be sent as requested. Brothers George W and Moses Thatcher were members of the "Journal" company, and the books are, I understand, in the possession of the former. The request to forward them has not been complied with, and as it will be impossible for me to make a suitable defense, and for the court to make an intelligent and just decision, without them, I respect- fully request that you will direct that they be forwarded. The follow- ing are wanted: All of the books belonging to or pertaining to the set in which the records and accounts of the firm were kept; the instrument by which Horace Cummings conveyed his partnerships interest to me; the last balance-sheet drawn by E B Burnett, business manager; the contract executed between myself and George ^W.^ and Moses Thatcher, in October 1884
